Car Accident Leaves Two Injured on I-64 in Hampton

A car accident on I-64 in Hampton resulted in two drivers suffering injuries. The accident came as a result of a driver’s attempting to switch lanes after entering the exit ramp, resulting in another car being driven into a ditch. Authorities are expected to press charges due to the event.

Virginia Woman Files Medical Malpractice Suit against VA Hospital for Sister’s Overdose

A Virginia woman filed a medical malpractice suit against the Hampton VA Medical Center in November 2012. She is blaming the hospital for her twin sister’s drug overdose death in 2010. According to the lawsuit, her sister, who had psychological issues and had attempted suicide three times before, was given four months of Seroquel by the doctor from the VA medical center. This is the same antipsychotic drug that she had used previously in her suicide attempts. Tragically, she was successful in ending her life the fourth time. The surviving sister is accusing the medical center of negligence in giving her troubled sister that much medication at one time.

Medical malpractice lawsuits arise when a doctor or other medical professional allegedly makes an error that causes injury or death to a victim. In this case it appears to be an error in judgment on the doctor’s part. The victim asked for two months’ worth of the prescription because she was going out of town. When she tried to pick it up at the center they said it was being shipped to her house. She told them she was leaving directly from there, so the doctor gave her two more months’ worth of pills. As her treating physician who was familiar with her history, the lawsuit alleges that the doctor should never have given her that much medication at one time.

Common Sense Still Needed After a Product Recall

My colleague published an article in the Legal Examiner talking about the risks associated with products that have received a “voluntary” recall notice. Parents must realize that just because the company took it upon themselves to issue the recall does not make the product any less dangerous. My colleague referenced the Bumbo Baby seat. Unfortunately, even with increased warnings and hazard indication after the company issued a voluntary recall, 84 reports of falls occurred after the first recall, leaving room to consider whether a second recall will actually cause any marked reduction in the incidence of injury in children using this product. Why Virginia has a “Move Over” Law

My colleague published an article in the Legal Examiner discussing why the “Move Over” law is important. For those of you who have never heard of the “move over” law, it basically requires you to change lanes and move over if there is a stopped emergency vehicle on the side of the road. Of course, the statute emphasizes that you must move over when it is reasonably safe to do so.

In the article, my colleague referenced a tragic accident that occurred on Interstate 64 (I-64) in Hampton involving a state tropper’s vehicle that was hit while it was stopped on the side of the road.
