Virginia Woman Files Medical Malpractice Suit against VA Hospital for Sister’s Overdose

A Virginia woman filed a medical malpractice suit against the Hampton VA Medical Center in November 2012. She is blaming the hospital for her twin sister’s drug overdose death in 2010. According to the lawsuit, her sister, who had psychological issues and had attempted suicide three times before, was given four months of Seroquel by the doctor from the VA medical center. This is the same antipsychotic drug that she had used previously in her suicide attempts. Tragically, she was successful in ending her life the fourth time. The surviving sister is accusing the medical center of negligence in giving her troubled sister that much medication at one time.

Medical malpractice lawsuits arise when a doctor or other medical professional allegedly makes an error that causes injury or death to a victim. In this case it appears to be an error in judgment on the doctor’s part. The victim asked for two months’ worth of the prescription because she was going out of town. When she tried to pick it up at the center they said it was being shipped to her house. She told them she was leaving directly from there, so the doctor gave her two more months’ worth of pills. As her treating physician who was familiar with her history, the lawsuit alleges that the doctor should never have given her that much medication at one time.
